Terms and Conditions for Seminar Participation (Onsite & Online)
Effective Date: January 1, 2024
These terms apply to all seminars (both in-person and online) organized by Med-Tronik GmbH / MORA Academy, unless otherwise specified.
1. Seminar Format
Seminars are organized by Med-Tronik GmbH / MORA Academy and may also be delivered in cooperation with authorized partners or trainers.
Where seminars are delivered by partners, they act on behalf of the organizer or as clearly identified co-organizers. Participants will be informed of the responsible party where relevant.
Seminars may be conducted either:
as in-person (onsite) events, or
as online (virtual) events via digital platforms. (e.g., Zoom, Microsoft Teams or similar).
Participants will be informed of the format in advance.
2. Seminar Registration
Registration can be completed online via: www.med-tronik.de
If internet access is unavailable, registration may be submitted in writing, including:
full name
company and billing address
contact details (phone, email)
Upon registration, participants will receive confirmation including seminar details and invoice information.
If the seminar is fully booked, participants will be notified promptly. Registration is considered accepted if no rejection is issued within 14 days. Participation is not guaranteed, and the organizer reserves the right to accept or deny participation.
By registering, participants agree to attend the seminar. Fees for late arrival, early departure, or partial attendance are non-refundable.
Seminar fees are based on the price valid at the time of registration and include seminar materials and a certificate of attendance.
Payment must be made in full no later than 14 days before the seminar start date (or immediately for short-term registrations). If payment is not received on time, access to the seminar and/or issuance of the certificate may be withheld.
Certificates of attendance are issued only if participation requirements are met.
3. Communication and Data Protection
Communication will take place using the contact details provided during registration.
Personal data will be processed solely for seminar organization, communication, and invoicing purposes, in accordance with applicable data protection laws, including the GDPR.
Data will not be shared with third parties without consent, except where required by law or necessary for seminar delivery (e.g., platform providers for online seminars).
Personal data may be shared with authorized partners or trainers where necessary for seminar delivery.
4. Technical Requirements for Online Seminars
Participants are responsible for ensuring that they meet the technical requirements necessary for participation in online seminars, including:
- stable internet connection
- compatible device and software
- access to the designated online platform
The organizer accepts no liability for technical issues on the participant’s side.
Access credentials are personal and may not be shared with third parties.
Access to online seminars may be time-limited and restricted to the scheduled session.
5. Cancellation, Rebooking, and Substitution
5.1 Substitution
A substitute participant may be appointed up to 48 hours before the seminar, subject to approval.
5.2 Rebooking
One free rebooking to an equivalent seminar is permitted up to 2 weeks before the seminar start date. After this period, rebooking will be treated as a cancellation.
5.3 Cancellation Policy
Up to 14 days before the seminar: no charge
14 to 7 days before the seminar: 50% of the fee
Less than 7 days or no-show: 100% of the fee
6. Cancellation by the Organizer
The organizer reserves the right to cancel seminars due to insufficient participation or circumstances beyond control (e.g., illness, force majeure, technical failure, government restrictions).
In such cases, paid fees will be refunded. No further claims (e.g., travel, accommodation, loss of income) will be accepted unless caused by gross negligence or intent.
7. Seminar Changes
The organizer reserves the right to make reasonable changes to:
- content
- schedule
- speakers
- location or platform
provided the overall character of the seminar is not significantly altered.
Participants will be informed of any changes without undue delay.
8. Participation and Conduct
Participants must behave in a respectful and appropriate manner.
Disruptive, abusive, or inappropriate behavior (including in online environments such as chat or video) may result in exclusion from the seminar without refund.
Participants must comply with all applicable safety and usage rules.
9. Travel and Accommodation (Onsite Seminars Only)
For in-person seminars, participants are responsible for organizing and covering their own travel and accommodation costs.
10. Health, Insurance, and Risk
Participation is at the participant’s own risk.
Participants are responsible for arranging appropriate insurance (health, accident, travel where applicable).
11. Intellectual Property
All seminar materials (including presentations, documents, recordings, and other content) are the intellectual property of the organizer unless otherwise stated.
They may not be reproduced, distributed, or used without prior written consent.
12. Recording and Media
The organizer may photograph or record seminars (both onsite and online) for documentation or promotional purposes.
Participants will be informed in advance where recordings take place.
By attending, participants consent to such recordings.
Participants are not permitted to record, photograph, or distribute seminar content without prior written consent.
13. Liability
The organizer is not liable for:
- technical failures beyond its control
- platform outages
- internet disruptions
- loss of data during online participation
Where seminars are delivered by partners, such partners are responsible for their own content and delivery. The organizer remains responsible for overall contract handling unless otherwise specified.
Liability is limited to the seminar fee paid per participant and per event, except in cases of:
- death or personal injury caused by negligence
- fraud or willful misconduct
- other non-excludable legal obligations
No liability is assumed for indirect or consequential damages.
14. Platform Use (Online Seminars)
Online seminars may be conducted via third-party platforms. The use of such platforms may involve the processing of personal data outside the direct control of the organizer.
Participants agree that the terms and privacy policies of the respective platform provider apply.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany.
Jurisdiction is the court in Offenburg, Germany.
16. Severability
If any provision of these Terms is invalid, the remaining provisions remain unaffected.
17. Right of Withdrawal (Consumers Only)
If the participant is a consumer within the meaning of EU consumer protection law, the following applies:
17.1 General Right of Withdrawal
Consumers generally have a right of withdrawal of 14 days. However, this right does not apply to contracts for services related to leisure activities (including seminars) where a specific date or period is provided.
The withdrawal period begins on the day the contract is concluded (i.e., upon registration).
To exercise the right of withdrawal, the participant must inform the organizer (e.g., via email) of their decision to withdraw.
17.2 Exclusion for Fixed-Date Events
The right of withdrawal does not apply to contracts for services related to leisure activities (including seminars) where a specific date or period is provided.
17.3 Early Expiry for Online Seminars
For online seminars (digital services), the right of withdrawal expires prematurely if:
- the seminar has already begun, and
- the participant has expressly agreed that the service may begin before the withdrawal period ends, and
- the participant acknowledges that they lose their withdrawal right once the seminar starts.
17.4 Refund Handling
If a valid withdrawal is made, payments received will be refunded within 14 days using the same payment method, unless otherwise agreed.
